BIR audit and assessment assistance in Leyte and Eastern Visayas

We assist taxpayers under audit by the revenue district offices of Revenue Region No. 14, Eastern Visayas, including Tacloban City and the rest of Leyte and Samar. An audit begins with a Letter of Authority and may proceed to a notice of the BIR’s findings, a Preliminary Assessment Notice, and a Final Assessment Notice with a Formal Letter of Demand.

The deadlines are short and fixed by law. Under Section 228 of the Tax Code, an assessment may be protested within thirty days from receipt. The supporting documents must be submitted within sixty days from the filing of the protest, otherwise the assessment becomes final. If the protest is denied, or is not acted on within 180 days from the submission of documents, the taxpayer may appeal to the Court of Tax Appeals within thirty days.

The BIR’s current audit procedures are summarised in our advisory on RMO No. 22-2026.

How we handle a BIR audit

  1. Read the notice. We establish the taxable period, the taxes covered, the date of receipt and the deadline that follows from it.
  2. Reconcile. Returns are reconciled with the books, the financial statements, and the third-party information the BIR holds, such as alphalists and summary lists of sales and purchases.
  3. Reply. We prepare the written reply or protest, with the schedules and documents that support each item.
  4. Represent. We attend the conferences with the revenue officers as your authorized representative.
  5. Close. The case ends with the settlement of any deficiency found to be due, or it is elevated. Appeals to the Court of Tax Appeals are handled with legal counsel.

The law we work from

The National Internal Revenue Code of 1997, as amended by the TRAIN Law, the CREATE Act, the Ease of Paying Taxes Act, the VAT on Digital Services Act, CREATE MORE and the CMEPA, together with the revenue regulations and circulars that implement them. The firm maintains a consolidated text of the Code as the AAC Tax Code, and publishes new issuances under News & Announcements.

Who needs it

  • Taxpayers who have received a Letter of Authority or an assessment notice.
  • Businesses that want their compliance checked before an audit, a sale or a loan application.
  • Heirs settling an estate, and donors transferring property.
  • Buyers and investors assessing the tax exposure of a target business.
  • New businesses choosing a structure and a tax registration.

Frequently asked questions

We received a Letter of Authority. What should we do first?

Record the date you received it, and note the taxable period and the taxes it covers. Gather the books and records it asks for. The periods for replying start to run from receipt, so the notice should be looked at immediately.

How far back can the BIR assess?

Generally within three years after the last day prescribed by law for filing the return, under Section 203. Where the return is false or fraudulent, or no return was filed, the period is ten years from discovery under Section 222.

How long must books and records be kept?

Five years, counted from the day after the deadline for filing the return for the year concerned, under Section 235.

When are estate and donor’s tax returns due?

The estate tax return is filed within one year from the decedent’s death (Section 90). The donor’s tax return is filed within thirty days after the gift is made (Section 103).

Do you also prepare the regular monthly, quarterly and annual returns?

Yes. The filing dates for the year are in the AAC Tax Calendar.
