AAC Tax Code.
The National Internal Revenue Code of 1997 as it currently stands — consolidated by the firm to carry the TRAIN Law, the CREATE Act, the Ease of Paying Taxes Act, the VAT on Digital Services Act, CREATE MORE, the CMEPA and the amendatory laws in force to 1 August 2026, with a footnote at every provision naming the law that changed it.
The printed edition runs to 240 pages and carries the same text, footnotes and references as the browser below. Every section here shows the page it sits on in that PDF, so a citation taken from the screen matches the one taken from the book.

For purposes of this Section, the term ‘gross sales’ means the total amount of money or its equivalent representing the contract price, compensation, service fee, rental or royalty, including the amount charged for materials supplied with the services during the taxable quarter for the services performed for another person, which the purchaser pays or is obligated to pay to the seller in consideration of the sale, barter, or exchange of services that has already been rendered by the seller and the use or lease of properties that have already been supplied by the seller, excluding value-added tax and those amounts earmarked for payment to third (3rd) party or received as reimbursement for payment on behalf of another which do not redound to the benefit of the seller as provided under relevant laws, rules or regulations: Provided, That for long-term contracts for a period of one (1) year or more, the invoice shall be issued on the month in which the service, or use or lease of properties is rendered or supplied.

Any export-oriented enterprise that fails to meet the threshold shall be disqualified from availing of VAT zero-rating in the immediately succeeding year: Provided, finally, That input tax otherwise due on VAT zero-rated local purchases attributable to VAT-exempt sales shall be paid and deductible from the gross income of the taxpayer. Amendment notes
- sec. 7 of Republic Act No. 11590, approved 22 September 2021, zero-rated services rendered to offshore gaming licensees. Republic Act No. 11590 was repealed in its entirety by sec. 18 of Republic Act No. 12312, the Anti-POGO Act of 2025, approved 23 October 2025, which bans and criminalises offshore gaming operations. The amendments it introduced are accordingly spent. Republic Act No. 12312 contains no clause reviving the text that preceded them.
- Subsection (A) and its definition of “gross sales”, and the new Subsection (C), as amended and added by sec. 17 of the Ease of Paying Taxes Act (Republic Act No. 11976), approved 5 January 2024, which replaced “gross receipts” as the tax base. Subsection (B) as further amended by sec. 7 of the CREATE MORE Act (Republic Act No. 12066), approved 8 November 2024: the item on services performed for export-oriented enterprises was restated with a seventy percent (70%) export threshold and a “directly attributable” test, a new item (8) on sales subject to zero percent (0%) value-added tax under special laws was added, and the proviso subjecting certain zero-rated services to the twelve percent (12%) value-added tax upon the establishment of an enhanced VAT refund system was removed. The amendments introduced by Republic Act No. 12023 on digital services are also reflected above.
